Plain terms for the site, the client portal and driver licences.
Who we are
BW Consulting ("we", "us") is a sole proprietorship based in Thornhill, Ontario, Canada. These terms cover this website, the client portal, the Driver Store and the BW Automation pages. Using any of them means you accept these terms.
The website
Content on the site is provided as general information about our services. Prices, availability and specifications can change without notice. We may change or remove any part of the site at any time.
Client portal accounts
Portal accounts are for current clients and the people they authorise. You are responsible for keeping your sign-in details private and for everything done under your account. Tell us at once if you think someone else has access. We may suspend an account that is misused or that belongs to a client we no longer serve.
Portal content
Site documentation, notes and credentials in the portal are provided for your own use in operating your systems. Do not share them with third parties. We keep them as accurately as we can, but you should verify anything critical before acting on it.
Driver Store purchases
A driver licence grants one Crestron Home processor, identified by its MAC address, a non-exclusive, non-transferable right to run the driver. The licence is bound to the processor and to the purchaser at the time of sale. It includes updates to the same driver while we publish them. It does not include installation or programming, which are separate services.
Trial, activation and refunds
Every driver runs for one hour after each processor reboot without a key, so you can test it before buying. Once a key is issued for a processor there is no refund, except where the driver does not work with the equipment listed on its product page and we cannot correct it. Keys can be moved to a replacement processor on request.
Payment
Prices are in Canadian dollars. HST applies where required. Orders paid by PayPal, Interac e-Transfer or QuickBooks invoice are fulfilled once the payment clears. We may cancel an order that is not paid within 14 days.
Bookings
Appointments booked through the site are requests until we confirm them. Please give 24 hours notice to cancel or move a visit. Onsite work is quoted separately and covered by the quote and invoice terms.
Software provided as is
Drivers and any other software from the store are provided as is. We work to keep them reliable and we fix defects we can reproduce, but we do not guarantee they will meet every requirement or work with every firmware version. To the extent the law allows, our liability for any claim relating to the software or the site is limited to the amount you paid us for the item concerned.
Intellectual property
The drivers, the site and its content belong to BW Consulting. Brand names and logos of manufacturers belong to their owners and appear only to identify the products we install and support.
Privacy
How we handle personal information is described in our Privacy page. Sign-in through Google or Facebook gives us only your name and email address.
Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes are handled in the courts of Ontario.
